Greene Broillet & Wheeler represented Targus in several malpractice cases against accounting giant KPMG, accusing it of failing to discover a three-year embezzlement scheme by the company’s CFO that caused $50 million in losses. In the process of litigating the case, an attorney for GBW discovered attorneys from Gibson, Dunn & Crutcher withheld documents in order to gain unfair advantage. The GBW attorney was able to uncover that Gibson’s attorneys violated court orders, lied about the existence of documents vital to the litigation and then refused to produce the documents.
An Orange County Superior judge at one point had to sanction the defense for its actions. The case eventually settled for $22.5 million.
